The construction worker is entitled to receive workers’ compensation benefits. The payment of workers’ compensation benefits is the employer’s responsibility. If someone other than the employer, a third party, is legally responsible, the injured worker can sue the third party for full damages. In most cases the residents and patients in nursing homes receive excellent medical care. Our firm has experience in representing victims of nursing home abuse and neglect and we can provide excellent representation to such a victim and their families.
– Premises Liability
The person injured as a result of a dangerous or defective condition of may also file a claim against persons other than the building owner, the landlord or tenant. An injured person may bring a claim against architects if the dangerous or unsafe condition was caused by negligent design, a builder or contractor may also be responsible for injuries caused by the failure to perform the construction in a workmen like manner or failure to comply with applicable building codes.
– Amusement Park Accidents
We all know amusement parks are fun. A trip to an amusement park is a great day’s outing. With so many people visiting amusement parks, injuries are bound to happen. While it doesn’t happen often, patrons suffer serious injuries at amusement parks, water parks, entertainment complexes, and sports facilities. The Consumer Product Safety Commission tells us there are hazard patterns associated with amusement ride related accidents.
– Crime Victim Rights
A victim of a crime does not control the criminal justice system. The State brings the criminal to justice. Unfortunately, the criminal justice system will not pay damages to the victim or the victim’s family for the harm done. Even if the victim is able to witness the perpetrator receive just punishment, the victim is left with physical, psychological, monetary losses and no compensation.
– Slip and Fall Accidents
When you visit a store, office building, mall or any other commercial property, you should not be injured. The owner and occupier of that property are responsible for your safety. This means they need to clean up spills, provide good lighting, remove ice and snow and make certain that there are no dangerous conditions which can injure you.
– Products Liability
Any manufactured product can be defective or unsafe. This applies to products used in our work as well as in our homes. Unsafe equipment such as cranes, lift trucks, power tools can be the cause of injury, which also gives rise to lawsuits. This does not mean that all accidents associated with a product are grounds for personal injury lawsuits. If the product has caused an injury either because of unsafe design, a manufacturing defect or the failure to provide proper instructions, a lawsuit can be filed.
– Flammable Clothing
Flammable clothing can cause serious and permanent injury and death. If the victim’s clothing caught fire as a result of the clothing having high flammability, lawsuits can be filed against the parties who were involved in the chain of distribution of the clothing as well as the person who started the fire or the company that sold that product responsible for igniting the fire.
– Forklift Trucks
Forklifts are highly productive machines designed to travel fast, raise, lower, and carry loads and maneuver within confined spaces. The inherent design characteristics that make the forklift the highly efficient material handler also make it very vulnerable to upset and other hazards. While forklifts are necessary tools for people who operate them and those who work around them, they cause many deaths and serious injury because they are prone to: collide with other forklifts, people or objects; being backed into people or objects; being used as an elevated work platform; tipping over on their side, especially narrow-isle forklifts; having objects fall from the forks due to poorly palletized materials or loose objects on shelving.
– Machinery & Equipment
Manufactures and suppliers of machines and equipment have a legal and moral duty to only sell safe products. If the machine is sold in an unsafe condition, either due to a manufacturing defect or a design defect, and the machine injures someone that person has a claim against the manufacturer, supplier or the distributor of the machine. Our firm is experienced in representing victims of serious injury or death due to the unsafe machinery and equipment. We can provide excellent representation.
– Power Tools
Manufacturers and suppliers of power tools have a legal and moral duty to only sell safe products. Many power tools contain a risk of injury due to unguarded moving parts. The moving parts of a power tool should have guarding to prevent serious injury. Injuries caused by portable power tools are burns, cuts and strains. Sources of injury include elective shock, particles in the eyes, fires, falls, explosions of vapors and gases and falling tools.
– Protective Equipment
Defective or unsafe personal protective equipment can be the subject to a “third party” lawsuit. The manufacturer, supplier and seller of personal protective equipment has a duty to manufacture, supply and sell the equipment in a safe condition or a condition safe for all foreseeable uses, containing no unsafe elements. If helmets, bump caps, hairnets, eye glasses for all occasions, respirators, gas masks, protective footwear, safety belts, safety lines, air supply hoods, flame retardant clothing, cold weather clothing, high visibility clothing and night hazard clothing, disposable clothing, leaded clothing, electromagnetic radiation suits, conductive clothing are defective or unsafe and if the defective or unsafe condition causes or increases an injury, the manufacturer, supplier or seller can be held legally responsible and be required to pay full and fair damage to the injured worker.
– Employment Law
Under Chapter VII of the Civil Rights Act of the United States and the Pennsylvania Human Relations Act an employee has the right to be free from discrimination in the workplace. However discrimination still occurs in regards to wages, hours, bonus and job assignment. The attorneys at Galfand Berger represent employees who have experienced discrimination because of their age, race, sex, national origin, religious affiliation, military status, disability or pregnancy.
